The Convention on the Rights of the Child (CRC) and its Optional Protocol on the sale of children, child prostitution and child pornography (OPSC) are the foundational international legal instruments designed to protect children. However, as these treaties were adopted before the widespread digital era, their provisions require a modern interpretation to effectively combat the increasing links between sexual offenses against children and the online environment. Our podcast will delve into our recent report to the CRC, which aims to foster a deeper understanding of these challenges, enable more effective implementation of the OPSC by States, and ensure the Protocol remains a robust instrument for child protection, regardless of how offenses are facilitated.

So I work clinically as a pediatric nurse
practitioner

with the child abuse team, at Children's
Hospital Colorado.

And with the Kempe Center.

And I became involved in this work
00:02:06:08 - 00:02:09:18
because of the patients
that I see in my clinical practice.
00:02:10:03 - 00:02:13:00
So seeing young adolescents,
00:02:13:00 - 00:02:16:03
as early as ten, 11, 12,
00:02:16:12 - 00:02:19:16
all the way up to 18, 19, 20,
00:02:20:01 - 00:02:22:17
who are experiencing,
00:02:26:12 - 00:02:29:07
Problems like child sexual assault,
00:02:29:07 - 00:02:32:16
adolescent sexual assault and meeting
00:02:32:16 - 00:02:35:16
their offenders online.
00:02:35:19 - 00:02:38:08
And so these young people
00:02:38:08 - 00:02:42:14
are showing up
where it's at a clinic or a hospital.
00:02:42:15 - 00:02:44:00
How does this happen?
00:02:44:00 - 00:02:47:05
They show up either
in an emergency department setting or in
00:02:47:05 - 00:02:51:21
an outpatient clinical setting,
and we see them as a team,
00:02:52:11 - 00:02:55:16
to evaluate any medical concerns
that they might have.
00:02:55:17 - 00:02:57:05
But listening to their stories,
00:02:57:05 - 00:03:00:07
to the histories that they tell us about
how they're meeting people.
00:03:00:19 - 00:03:04:04
It's moved from when I started my career
to meeting people,
00:03:05:04 - 00:03:09:24
on the in
a, in a very organic setting in person
00:03:10:02 - 00:03:14:00
to now, almost all of the people
that I see are meeting people online,
00:03:14:00 - 00:03:18:03
on apps, on their mobile phones
or other devices,
00:03:18:12 - 00:03:21:11
and that's how they're meeting them
and having
00:03:21:11 - 00:03:25:14
very little conceptual awareness
that the person on the other end
00:03:25:14 - 00:03:30:18
of that conversation on an app
is not likely who they said they were.
00:03:30:24 - 00:03:32:00
And they don't realize that
00:03:32:00 - 00:03:34:15
until they meet them in person
in something that happens.
00:03:35:15 - 00:03:36:12
And what is that
00:03:36:12 - 00:03:39:12
something that
what are we talking about here?
00:03:39:13 - 00:03:42:12
We're talking about either
physical assault, sexual assault,
00:03:42:12 - 00:03:47:01
sextortion, or being sex
trafficked or human trafficked.
00:03:48:00 - 00:03:49:24
And you see that in your practice.
00:03:49:24 - 00:03:53:02
How often is this once in a blue moon
kind of thing?
00:03:53:22 - 00:03:58:05
No, unfortunately, this is, pretty common
in terms of the patients
00:03:58:05 - 00:04:02:03
that we see
we're seeing in a pediatric focused.
00:04:02:03 - 00:04:06:05
So really 0 to 18 years of age,
we're seeing,
00:04:07:14 - 00:04:12:11
in terms of acute or cases of patients
that will need,
00:04:13:12 - 00:04:17:03
forensic evidence collection,
commonly known as rape kits.
00:04:17:11 - 00:04:22:23
We're seeing around 120 to 130 patients
a year. Wow.
00:04:22:24 - 00:04:27:11
And even more than that in a non acute
setting in terms of people
00:04:27:11 - 00:04:30:11
who don't need
that forensic evidence collected.

who are
00:04:34:22 - 00:04:37:23
you and what's been your relationship
to all this?
00:04:38:16 - 00:04:41:11
I am Denise’s colleague
I'm a child abuse pediatrician.
00:04:41:11 - 00:04:43:05
We're on the same team.
00:04:43:05 - 00:04:45:15
So we do very similar clinical work.
00:04:45:15 - 00:04:48:15
And I would say
when I first started this work,
00:04:49:07 - 00:04:53:12
over 20 years ago, as Denise mentioned,
it was pretty uncommon
00:04:53:12 - 00:04:58:10
to see a, children
who had been exploited, via technology.
00:04:58:21 - 00:05:01:23
And over the last 5 to 10 years,
00:05:02:05 - 00:05:05:05
that experience is really exploded.
00:05:05:07 - 00:05:08:22
I would say most of the cases that we see
are adolescents, as Denise mentioned,
00:05:09:09 - 00:05:12:24
because they're commonly interfacing
with social media.
00:05:13:14 - 00:05:16:14
Which I think
everyone is aware of nowadays.
00:05:17:04 - 00:05:19:16
But we have had cases of infants
00:05:19:16 - 00:05:22:16
who have been sexually abused in their,
00:05:22:17 - 00:05:25:01
videos or photographs posted online.
00:05:25:01 - 00:05:29:13
We became aware of them
because a large tech, internet company
00:05:30:07 - 00:05:34:17
identified those photographs
through some of their security measures
00:05:34:17 - 00:05:39:03
and let us know so that we could see the
child and check that infant out medically.
00:05:39:17 - 00:05:42:07
Those cases are rare, but they,
00:05:43:14 - 00:05:44:13
they exist.
00:05:44:13 - 00:05:48:20
And we know that across the internet,
those cases are increasingly more common
00:05:49:17 - 00:05:52:14
for the adolescents.
00:05:52:14 - 00:05:57:05
We see kids who are vulnerable,
who are perhaps
00:05:57:05 - 00:06:01:10
having challenges in their personal lives
or at home, who then meet folks online
00:06:01:10 - 00:06:05:22
who take advantage of that vulnerability
and ultimately end up exploiting them.
00:06:05:23 - 00:06:09:00
And as Denise mentioned, they can be
in a variety of different ways.
00:06:10:00 - 00:06:12:05
It sounds like technology
00:06:12:05 - 00:06:15:05
has changed this landscape.
00:06:15:09 - 00:06:18:09
And the child welfare professional,
and I'm very aware
00:06:18:24 - 00:06:22:11
of historically predators
00:06:22:11 - 00:06:25:11
gathering around residential treatment
centers and group homes,
00:06:26:04 - 00:06:28:10
predators gathering around places like bus
00:06:28:10 - 00:06:31:10
stations and truck stops and whatnot.
00:06:31:20 - 00:06:34:09
I got your report
00:06:34:09 - 00:06:37:09
in my hands
that we'll talk about in a second.
00:06:37:11 - 00:06:41:09
But one of the people
that you all interviewed said predators
00:06:41:09 - 00:06:46:14
online have access to a whole population
that you never had access to before.
00:06:47:03 - 00:06:50:14
Which means that we have a significant
increase in tween age
00:06:50:14 - 00:06:54:15
children and adolescent children who are
being exploited just because of the access
00:06:55:03 - 00:06:58:15
that people have
to them in the digital world.
00:06:59:15 - 00:07:01:08
So how does that happen?
00:07:01:08 - 00:07:03:23
I mean, I think a parent could imagine
00:07:03:23 - 00:07:06:23
their kid,
you know, meeting a stranger online.
00:07:07:10 - 00:07:12:10
But how does that
how do we go from a innocent contact
00:07:12:11 - 00:07:15:23
to start on some kind of platform
to this kind of harm?
00:07:15:24 - 00:07:18:24
You're talking about rape
and other forms of violence.
00:07:19:06 - 00:07:21:03
How does that happen?
00:07:21:03 - 00:07:24:22
Well, I don't think it'll surprise
anyone that kids are increasingly,
00:07:25:08 - 00:07:28:09
given access to the internet
at younger and younger ages.
00:07:29:10 - 00:07:32:10
And, people online can,
00:07:32:22 - 00:07:37:14
create profiles that do not
accurately depict who they are.
00:07:38:06 - 00:07:41:15
So the,
the technology has some pretty special,
00:07:41:16 - 00:07:45:15
you know, characteristics
that make this sort of perpetration easier
00:07:45:15 - 00:07:49:02
than, you know, walking up to someone
and seeing someone in person.
00:07:49:02 - 00:07:52:11
But I had a case of a 14 year old
00:07:52:11 - 00:07:55:15
who had been bullied at school
and was struggling.
00:07:55:15 - 00:07:58:11
She, lived with her mom, who was single.
00:07:58:11 - 00:08:02:03
Mom was working a lot
and not in the home and able to supervise,
00:08:02:10 - 00:08:05:10
media as well as maybe
she would have even liked.
00:08:05:22 - 00:08:07:11
And they had some conflict.
00:08:07:11 - 00:08:08:24
They weren't getting along really well.
00:08:08:24 - 00:08:11:24
And she was approached on a very common,
00:08:12:03 - 00:08:16:11
social media site by someone who said
that they were a teenager
00:08:17:02 - 00:08:20:21
and started to,
just develop a friendship with her.
00:08:21:11 - 00:08:25:11
And then over time
admitted that that they were older
00:08:25:11 - 00:08:27:00
and admitted that they were an adult.
00:08:28:04 - 00:08:29:02
But by then they
00:08:29:02 - 00:08:32:02
had developed a friendship that a trust.
00:08:32:03 - 00:08:35:03
And, and this person,
00:08:35:24 - 00:08:39:03
was seen as a sort of a confidante
to this young,
00:08:39:03 - 00:08:42:23
vulnerable adolescent who was struggling
in other domains in her life
00:08:43:14 - 00:08:46:02
and the turn of events that really
00:08:46:02 - 00:08:49:08
that really brought everything to a
to a had.
00:08:49:08 - 00:08:53:16
Was it she,
dropped her phone and broke it and,
00:08:54:02 - 00:08:57:12
he promised to buy her a new phone
if they could finally meet in person.
00:08:58:08 - 00:09:00:18
And when they eventually met,
00:09:00:18 - 00:09:03:18
she was sexually assaulted by this person.
00:09:04:06 - 00:09:06:15
And, fortunately,
00:09:06:15 - 00:09:10:07
disclosed what had happened
and came to us for care, but it was,
00:09:10:14 - 00:09:13:14
it was a really tough case,
but I would say it was,
00:09:13:24 - 00:09:17:05
illustrative of common stories
00:09:17:09 - 00:09:20:09
that we hear over time.
00:09:21:04 - 00:09:23:24
And I, I don't think it has to even be
00:09:23:24 - 00:09:27:02
as insidious as Antonia
00:09:27:02 - 00:09:30:24
just described,
because within about two weeks of meeting
00:09:30:24 - 00:09:34:18
a new friend online, kids are being asked.
00:09:34:18 - 00:09:35:18
Youth are being asked
00:09:35:18 - 00:09:39:21
to send photos, to send images,
to send things to other people.
00:09:40:11 - 00:09:43:08
And then those images are no longer
their possession.
00:09:43:08 - 00:09:47:21
And those images are being sent out
into the internet, into the into
00:09:47:21 - 00:09:52:18
the World Wide Web of this network
for people to be able to see.
00:09:53:07 - 00:09:55:18
And that causes additional
00:09:55:18 - 00:09:59:01
duress and exploitation in other ways.
00:09:59:01 - 00:09:59:23
So you have this,
00:10:00:23 - 00:10:03:23
this spectrum that ranges from,
00:10:04:09 - 00:10:07:04
asking for photos all the way to
00:10:07:04 - 00:10:11:09
we get to the end point
that, Doctor Kaso was just talking about
00:10:11:09 - 00:10:16:02
in terms of meeting in person
for the first time, after you've developed
00:10:16:02 - 00:10:18:05
what you think
is a relationship with somebody
00:10:18:05 - 00:10:21:14
who's your friend,
who's your confidant, who cares about you,
00:10:22:02 - 00:10:25:20
and now you're in a space
where you've been assaulted,
00:10:25:20 - 00:10:28:20
physically, sexually harmed by them,
00:10:29:01 - 00:10:31:21
traumatized by that individual,
00:10:31:21 - 00:10:35:22
and figuring out how to recover from that,
how to have supports,
00:10:35:22 - 00:10:39:21
how to get your bodily autonomy back
and learn how to trust people again.
00:10:39:21 - 00:10:41:09
And in a world where
00:10:41:09 - 00:10:44:09
you have no idea who you're talking to
on the other end of that,
00:10:44:23 - 00:10:48:01
that application, the internet,
wherever you're meeting people.

Warren, how did

this lead to the report
that I have in my end?
00:10:55:21 - 00:10:59:04
And help us understand

what could be the role of something like
the United Nations in something like this?
00:11:02:22 - 00:11:06:21
We think of the UN
as this big August organization
00:11:06:21 - 00:11:09:21
dealing with international crises
and whatnot.
00:11:10:18 - 00:11:13:01
What is this report war,
and how does this relate
00:11:13:01 - 00:11:16:01
to the United Nations,
and how does this help?
00:11:16:14 - 00:11:20:06
Well, basically,
the challenges that we're seeing here in
00:11:20:06 - 00:11:23:20
the United States are challenges
that are being seen worldwide.
00:11:24:06 - 00:11:28:02
Starting with the abuse
and exploitation of children.
00:11:28:11 - 00:11:33:08
And so the global community came together
in the late 20th century,
00:11:33:15 - 00:11:39:15
and they developed a series of treaties
that tried to commit all of the countries
00:11:39:15 - 00:11:44:15
in the world to combating what at the time
was called child prostitution.
00:11:44:15 - 00:11:47:08
Child pornography,
and the sale of children.
00:11:47:08 - 00:11:53:02
And the United States is a party
to a treaty that obligates countries
00:11:53:07 - 00:11:57:13
to combat these crimes
and to provide care to children,
00:11:57:13 - 00:12:01:18
and to pursue justice on their behalf
and on behalf of the public.
00:12:02:03 - 00:12:06:18
And so the chair of the U.N.
00:12:06:18 - 00:12:08:23
committee, it's
called the UN Committee on the rights.
00:12:08:23 - 00:12:12:00
A child was visiting c
00:12:12:00 - 00:12:16:12
u and shoots in the chem center last fall,
and she talked to
00:12:16:12 - 00:12:20:16
some of our frontline providers
and was amazed by the work that they do.
00:12:21:00 - 00:12:25:00
And she invited us to submit a report
to the UN
00:12:25:14 - 00:12:29:20
explaining what it is that we're seeing
on the front lines, the challenges
00:12:29:20 - 00:12:33:24
our frontline providers face in
trying to provide care for these children,
00:12:34:09 - 00:12:37:15
as well as to assess
whether or not the U.S.
00:12:37:15 - 00:12:41:05
is complying with its treaty obligations
under this treaty.
00:12:42:06 - 00:12:43:18
And what is that treaty called?
00:12:43:18 - 00:12:45:21
Is this the convention
on the rights of the child?
00:12:45:21 - 00:12:48:21
I think some of our listeners
have heard about that.

No, this is not that treaty,
but this is a related treaty.

The U.S.
00:12:53:06 - 00:12:56:13
is not a party to the UN convention
on the rights a child.
00:12:56:22 - 00:12:59:00
This treaty is called the,
00:12:59:00 - 00:13:02:10
the Optional Protocol to the convention
on the rights of a child
00:13:02:19 - 00:13:06:13
on the Sale of Children,
Child prostitution and Child Pornography.
00:13:06:21 - 00:13:09:14
Those of us who are international lawyers
00:13:09:14 - 00:13:12:15
refer to it
as simply the Second Optional Protocol.
00:13:13:04 - 00:13:18:05
And so it's a related treaty,
but it's a fully independent treaty
00:13:18:12 - 00:13:22:01
in that a country can obligate itself
00:13:22:14 - 00:13:25:01
under the Second Optional Protocol
00:13:25:01 - 00:13:28:19
without having been a party
to the original convention on the rights.
00:13:28:19 - 00:13:30:11
A child got it.
00:13:30:11 - 00:13:37:05
And then what is the role, the purpose
of a report being submitted like this?

What does that do? Where does that go?
What happens?

So basically, the world's, treaties
00:13:42:20 - 00:13:46:23
that focus on children,
they are reporting treaties.
00:13:46:23 - 00:13:47:23
In other words,
00:13:47:23 - 00:13:52:05
they're difficult to enforce
because their purpose is not enforcement.
00:13:52:05 - 00:13:56:08
In most cases, there is a treaty
that does try and allow an opportunity
00:13:56:08 - 00:13:59:13
for an individual child
or group of children to settle a complaint
00:13:59:22 - 00:14:03:14
that most of the child,
children's treaties, including this one,
00:14:03:22 - 00:14:08:18
try and help the world
to create a better society,
00:14:08:22 - 00:14:14:15
nation by nation, by obligating
every party, every state party to report
00:14:14:15 - 00:14:18:14
how it's doing, how is it fulfilling
its duties under the treaty.
00:14:18:14 - 00:14:24:09
And so about every five years or so, under
sometimes seven years, the,
00:14:24:12 - 00:14:27:24
the countries that are parties
to this particular treaty,
00:14:28:04 - 00:14:33:11
they file a very substantial report
saying, here are all of the things
00:14:33:11 - 00:14:37:19
that we're doing to combat child
prostitution, to combat
00:14:38:06 - 00:14:41:22
child pornography, and to combat
the sale of children in the United States.
00:14:42:15 - 00:14:44:10
And this treaty or.
00:14:44:10 - 00:14:48:21
Sorry, excuse me, this report was filed
as part of that reporting
00:14:48:21 - 00:14:50:03
process with the UN.

So the three of you are

for this report generated?

what we did was we invited, the three
law students that you just mentioned

from Sue Law school to, to join us

in interviewing and surveying

frontline
professionals across the United States
00:15:28:23 - 00:15:32:10
and asking them specific questions
about what
00:15:32:10 - 00:15:36:20
they're seeing on the front lines
within the framework of the treaty,
00:15:36:20 - 00:15:39:21
to determine
if there were any parts of the treaty
00:15:39:21 - 00:15:42:21
that the United States
was not in compliance with.
00:15:43:01 - 00:15:47:17
And so the report is basically a summary
of those interviews
00:15:47:17 - 00:15:50:24
and surveys of frontline professionals
from around the United States.

And I notice

it is filled with direct quotes
from those frontline professionals

of what they are seeing
and what they're experiencing.

did you do to engage with these folks?

How did this happen?

These are people that we work with
routinely, either in a medical setting.
00:16:15:05 - 00:16:19:09
So people who work in emergency department
settings, in clinical settings
00:16:19:19 - 00:16:23:04
and or people who work in law enforcement,
social services
00:16:23:04 - 00:16:26:24
or the child welfare system
in juvenile assessment centers,
00:16:26:24 - 00:16:30:06
who all are seeing the same concerns
00:16:30:06 - 00:16:33:06
about exploitation.
00:16:33:08 - 00:16:36:09
Within are within the systems
in which we work.
00:16:36:09 - 00:16:40:12
And our systems intersect
in very interesting ways.

And because this is really
a multi-disciplinary problem,
00:16:44:17 - 00:16:48:02
meaning it takes sort of the heads
of a lot of different types
00:16:48:02 - 00:16:51:19
of professionals
to tackle these complex cases.

We decided to
interview not just medical professionals,
00:16:56:11 - 00:17:01:23
but folks like social workers or law
enforcement officers, those community
00:17:01:23 - 00:17:06:03
type providers who might be employed
by a nonprofit, for example,
00:17:06:12 - 00:17:10:02
who are specifically,
involved in human trafficking.
00:17:10:12 - 00:17:13:05
And spoiler alert,
00:17:13:05 - 00:17:16:08
they found some challenges
with that treaty
00:17:16:08 - 00:17:19:24

so that, for example, we are seeing live

either pay or persuade a child to,

be have
their abuse live streamed remotely.

Sometimes the victim
is in the United States, oftentimes

they are overseas
and we don't have the international

jurisdiction set up to adequately go
after these live streaming cases.

We also, in other research,
have looked at grooming and luring that.

a federal law was passed

that basically said
that they could not be held

liable for what
other people did on their platforms.

And the technology industry
has relied on that.

Section 30 of the Communications Decency
Act for the last 30 years

what's going on on their platforms.

In fact, they moved in the other direction
that we now have algorithms

who will see that someone,

an adult male, is highly interested
in a 12 year old girls,

and that algorithm will actually feed them
more and more 12 year old girls.

And yet we can't hold the internet
platforms responsible
00:26:28:12 - 00:26:34:18
for that behavior, that misbehavior,
because of section 230 of the CDA.

And so what we really need to do
is to address the fact

that the tech companies are not
being passive neutral platforms anymore,
00:26:43:07 - 00:26:48:06
but they actually are putting predators
and children together, which is furthering

their victimization and putting them
at risk of sexual abuse and exploitation.

And so that's the background
to the problem

that we're we're trying to address
and that we're trying to urge both,

you know, federal lawmakers
as well as state lawmakers to do more

to regulate the platforms so that
they don't put children in harm's way.

to turn off those algorithms,

especially for our children,
who should not have predators forced into,

you know, their feed and suggested,
as you know, potential contacts or friends

and, and more.

there's even things like you can

you need age verification
for joining certain types of things.

you need to have an age verification,
which they do.

You don't have to verify your age
in certain ways.

You can just make up a birth date
to be able to get into

some of these platforms
and start participating in,

using apps or Snapchat or Twitter

whatever platform you're using.

And they're not verifying your age
when that would be a secondary,

easy solution
to try to keep very young tween age

And so we have predators
who are pretending,

you know, they're going into these
these children's gaming sites

and becoming friends
through these games with children

and then trying to groom them,
00:29:13:05 - 00:29:15:21
lure and groom them for exploitation.

And if we have age verification,
not just for pornography sites

like we have already for gambling sites
and liquor sites,

we have that for pornography sites.

And in the case of, you know,
children's apps or, you know, those,

those platforms that include children
and youth have age verification there

and limit the adults
who can access them to those that either,

approves, then we're not going to have

actively to help keep them safe.

where you have to intervene,

legislation that the camp senator supports

and has been working on advancing,
called the Kids Online Safety Act.

a vote potentially
during this congressional session.
